EB-5 Timeline

  • DAY ONE:

    Foreign Investor signed EB-5 Subscription Agreement for a qualified project and invests $1,000,000 or $500,000 in the project. Administrative Fees and Legal Fees must also be deposited.

    Investor’s immigration Attorney prepares and files I-526 petition to USCIS.

  • MONTH 2 - 24:

    I-526 Petition is reviewed by the USCIS. Upon approval of the application, a conditional Green Card is granted for 2 years.

    If USCIS denies the petition, then EB-5 Investment is returned to investor.

  • YEAR 2 – 4:

    Following approval, investor will receive conditional Green Card with 2 year validity. The investor, spouse, and all unmarried children under 21 can live, work, travel to anywhere within the United States without restrictions.

  • YEAR 4:

    90 days before conditional Green Card expires, immigration attorney files I-829 petition for lifting of conditions on Green Card.

    This is contingent on the job creation confirmation of the EB-5 Project.

  • YEAR 5:

    Investor can be returned the EB-5 Investment or maintain an equity position with steady annual returns.
